      <image:title>Financial matters</image:title>
      <image:caption>The third step is to assess what you both need for the future. Here, we really need to get to know you, your partner and your family. We will ask you about your ages and state of health (including ill health that impacts on your ability to earn income and support yourself), the care arrangements for your children and also the incomes that you earn.</image:caption>
    </image:image>
    <image:image>
      <image:loc>https://static1.squarespace.com/static/587c6861d482e9504a30bdef/t/58c257baa5790ae22305f4c3/1489131529315/</image:loc>
      <image:title>Financial matters</image:title>
      <image:caption>Once we have completed all three steps, we will then be able to provide you with legal advice about your financial settlement options. This legal advice will be based upon the legal principles of "fair" which often do not translate into what is morally fair or fair to you or your family. That's why it is so important to design your own pathway towards settlement focusing on what is important to you and your family rather than a Court imposing an outcome upon you.</image:caption>
    </image:image>
    <image:image>
      <image:loc>https://static1.squarespace.com/static/587c6861d482e9504a30bdef/t/58c256cd725e25f24c19bc0c/1489131293635/what+di+you+have.JPG</image:loc>
      <image:title>Financial matters</image:title>
      <image:caption>The first step is to identify what you, your partner and your family owns and owes, including:· 1. Your assets (eg. family home, cars, savings, shares and investments, your business; 2. Your debts (eg. home mortgage, credit cards, or personal loans); and 3. Your superannuation; Once your assets, debts and superannuation have all been identified, we then move towards determining values. This is commonly referred to as the valuation and financial disclosure process.</image:caption>
    </image:image>
    <image:image>
      <image:loc>https://static1.squarespace.com/static/587c6861d482e9504a30bdef/t/58c2581e3a04110deeeb8467/1489131671026/what+did+you+contribute.JPG</image:loc>
      <image:title>Financial matters</image:title>
      <image:caption>The second step is to assess both of your contributions which are of a financial and non-financial nature (eg. your role as homemaker or parent). Contributions are historical in nature so we take you through each stage of your relationship to establish: 1. What you both owned or owed at the beginning of your relationship; 2. What roles you both had during your relationship. For instance, who earned the income, who cared for the children - perhaps it was a combination of both - or did either of you receive an inheritance? 3. What has occurred since your separation. For instance, who is paying the mortgage, the household bills and the kid's expenses?</image:caption>

      <image:title>Parenting matters</image:title>
      <image:caption>For some families, arrangements are working well and all that is needed is for us to document the agreement. Other families might need some extra help to reach an agreement. We offer guidance and legal advice, including the option of involving child-focused specialists to assist your family. For example, mediation or counselling or the forum of collaborative practice are excellent options which support the co-parenting relationship and work towards achieving the most positive and sustainable outcomes for your family. Whatever the case, we can help you with the most appropriate pathway towards agreement and avoid court imposed decisions.</image:caption>

      <image:title>Parenting matters</image:title>
      <image:caption>This is a difficult question we need to ask. Careful consideration is given to the benefits of a child having a meaningful relationship with both parents. However, this must be weighed up with the need to protect the child from physical or psychological harm. For example, being subjected to, or exposed to, abuse, neglect or family violence. Please speak with us if you have any concerns.</image:caption>

      <image:title>Parenting matters</image:title>
      <image:caption>It's important that we understand the current arrangements for your children. Parenting arrangments will differ for each family and are dependent on the age and maturity of your children. For example, what works well for a 14 year old, may not work so well for a 4 year old. It may be that the current arrangements are working well and you simply wish to document your agreement. Or, it may be that current arrangements are not working so well and you need some guidance and legal advice on how to get things on track for your family.</image:caption>

      <image:title>Parenting matters</image:title>
      <image:caption>We need to get to know your children too. We will ask you lots of questions about them including their ages, their interests and about their schooling. Do they have any special or additional needs? We'd like to know more about their relationships with you, your partner and their siblings. What about your family's lifestyle, culture and traditions? How are they coping with separation? Perhaps they need some extra support? We work with many child-focused specialists who can offer your children the extra support they may need.</image:caption>

      <image:title>Your options</image:title>
      <image:caption>The court process is your last resort. Unfortunately for some separating couples, court is an option they are forced into, especially when there is a high level of conflict and communication has completely broken down. Whilst we have the necessary expertise in helping you with your court case, our aim is to get you through the process as quickly and cost effectively as possible. Damage may be limited with an early settlement agreement. If resolution cannot be achieved in the early stages of the court process, those fears of unnecessary delays, poor communication, increased conflict and significant legal costs become a reality. The damage is further intensified by court imposed outcomes. Given the complexities and potential unforeseen difficulties with the court process, it is by far the most expensive of your options.</image:caption>

      <image:title>Your options</image:title>
      <image:caption>This option involves you and your partner attending a series of meetings with your collaboratively trained lawyers. There is also an opportunity to include neutral collaboratively trained parenting/child and financial specialists which enhances sustainable outcomes for your family. Collaborative practice is a "team" approach - we all work together, not against one another. We will focus on your interests and goals at all times - you are in the driver's seat. We also have the freedom to be creative with settlement solutions that will work for you and your family. Once an agreement is reached, we will also document it for you. Collaborative practice reduces conflict and protects your family relationship for the future. Jacque and Dani are both collaboratively trained lawyers and work with many well trusted collaborative professionals. You may need a number of meetings, so we will help you find the most affordable pathway. Talk to us about a fixed fee.</image:caption>

      <image:title>Your options</image:title>
      <image:caption>Lawyer negotiation is an option most common for separating couples when communication has broken down. Many people assume that their only option is to engage a lawyer to undertake all of their negotiations and they become the by-standers in their future. Understandably, this conjures up many fears, including unnecessary delays, poor communication, increased conflict and of course, significant legal costs. Our aim to is move you through this process in the most swift, amicable and cost effective way. We may suggest moving towards mediation or a round table conference (with your partner and their lawyer) which shifts the focus towards potential settlement outcomes and away from those fears. If we are able to resolve your matter reasonably quickly then this will be reflected in the cost. Talk to us about a fixed fee.</image:caption>

      <image:caption>This option is for couples who have already reached an agreement themselves. We will provide you with some guidance and advice about the legal implications of your settlement agreement and then document it for you. As you have already done the work, this is your quickest and cheapest option. Talk to us about a fixed fee.</image:caption>

      <image:title>Your options</image:title>
      <image:caption>This option involves an independent mediator or counsellor who works with you and your partner to facilitate settlement discussions between you. We will provide you with guidance and advice about your potential settlement outcomes which will prepare and empower you to move into mediation. Alternatively, you and your partner may prefer to have your lawyers present at mediation. We can help you with this too. Once you have reached an agreement in mediation, we will then document it for you. You may need 1, 2 or 3 mediation sessions but you design the timeline. The mediation and settlement document process is an affordable one. Talk to us about a fixed fee.</image:caption>
